Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5. by Philip Lindquist, Chairman, in Meeting Room A on the top floor at the Town Hall.

Certificate of Compliance

7:30 PM  Request for Certificate of Compliance for Tag Way, SE 175-341  

John Delano, the Design Engineer for the applicant, presented a response letter addressing Ms. Delaney’s previous comments concerning the stormwater basins and other issues.  In summary, the basin that spans Lot 1 & 2 is a detention basin meant to hold water for only a short time such as during a storm.  Ms. Delaney commented that the Operation and Maintenance Plan should be approved by the Highway Department and distributed to the property owners regarding the long-term maintenance of the basins and swales.  Ms. Delaney recommended that that the Certificate of Compliance be issued with the condition that the Planning Board withhold monies being held pending establishment of vegetation around the basin and submission of a revised O & M Plan.

Public Hearings

7:45 PM  Abbreviated Notice of Resource Area Delineation for the confirmation of a wetland line at 1101 Rear Main Street, Map 42, Lots 60 & 60A for Frank Bridgeman represented by Land Planning, Inc., 1115 Main Street, Hanson, MA  (DEP #175-498)  (New Hearing)



David Harris read the Public Hearing Notice and the abutters were verified.  Frank Bridgeman, applicant and Sharon LePorte, who performed the delineation attended the hearing.  A  letter from the Commission’s Review Engineer, Dr. Walter Hewitson, was presented to them as it was only just received.  Dr. Hewitson disputed the wetland line behind the existing building because areas that were not flagged as wetland were underwater.  Ms. LaPorte stated that because the area was previously paved and historically filled, it is not serving a resource purpose and is “made land”.  Ms. Delaney commented that the standing water and wetland vegetation defined an existing wetland and possibly land subject to flooding.  She suggested that a site walk is scheduled.  Mr. Lindquist read the abutters list.  One was present.

8:00 PM Continued Notice of Intent for construction of a single family home, driveway and utilities as well as a proposed wetland crossing at 30 Holmes Street, Map 75, Lot 5-1 for Anthony Kolacz represented by Kenneth Thomson, 134 Spring St., Rockland MA  (DEP #175-0495)

Ken Thomson, Engineer, and Doug Bailey, Surveyor attended the hearing.  In response to Ms. Delaney’s comment letter of March 14th, Mr. Thomson made a minor change to the plan with regard to the width of the driveway for fire truck access and modification to the design of the crossing box culvert.  Some of Ms. Delaney concerns were that this is a Limited Project proposal and in fact, DEP had asked for an Alternative Analysis. The lot was created after the 50-foot No Disturb regulation was enacted and therefore may not be approvable.  If the project is approved, Ms. Delaney suggested that the Commission require an alternative alignment of the access which would require reconfiguration of the lots.  Also, a narrative of the Wetlands Mitigation Plan should be included for reference. Mr. Thomson replied that if the plan is revised and the existing cartpath is utilized, a Water Quality Certification Permit would have to filed with the DEP and Army Corp. of Engineers Permit acquired.

8:15 PM Continued Notice of Intent for a revised proposal for the construction of eight (8) single-bedroom condominium units with parking and septic within 100 feet of a bordering vegetated wetland at 1139 Main St., Assessor’s Map 43, Lots 36A & B and 36.  A portion of the construction falls within the 100-foot inner riparian zone. Proposal includes clean up of existing construction debris and soils on Lot 36.   Applicant:   Demco Enterprises, Inc., 31 Perkins Street, Bridgewater, MA  02324 represented by Land Planning, Inc.. (DEP #175-0460) – continued  to May 9th at 8:15 PM per request of engineer

8:30 PM  Notice of Intent for the construction of a single family house, subsurface septic disposal system, driveway and associated grading at 691 East Washington St., Map 114, Lots 12 & 15, Lot 5 for Edward G. Johnson represented by Land Planning, Inc., 1115 Main St., Hanson, MA  (DEP #SE175-500)  (New Hearing)

Dave Harris read the Public Hearing Notice and the abutters were verified.  Bob Crowell from Land Planning presented the plan.  The lot abuts the Indian Head River, but the work is out of the 200-foot Riverfront area.  A small portion of the driveway and grading is within the 100-foot buffer zone.  A detail for a proposed retaining wall is not shown on the plan.  Mr. Johnson had agreed to prepare an Operation and Maintenance Plan that included a Homeowners Association per the request of the Highway Department.  Ms. Delaney suggested conservation markers placed at the 50-foot no-disturb zone, a crushed stone apron at the entrance and the correct address shown on the plan.  Mr. Lindquist asked for comments from abutters.  Those present were:

Dave Harris read the Public Hearing Notice and the abutters were verified.   Bob Crowell made the presentation for a proposal for a 4-bedroom house with the septic in the front.  A portion of the house is within the 100-foot buffer zone.  Haybales are proposed along the 50-foot.  Ms. Delaney had the same comments as for the previous filing.  Mr. Lindquist asked for comments from abutters.

Dwight Howard, 860 Winter Street – Who is responsible for maintaining the Detention Basin?
Mr. Johnson replied that the Homeowners Association would maintain.

Dwight Howard, 872 Winter Street – What is involved with the maintenance?  Mr. Johnson replied, mowing, weedwacking.

Revised Conditions – 19+ Conditions revised.  Commission to provide option of presenting changes on one document of re-filing for an Amended Orders of Conditions.
*Vernal Pool Habitat – Ms. Delaney reported three isolated wetlands in the 100-foot buffer zone.  Egg masses and fairy shrimp were observed in Wetland J.
Brookside II – Ms. Delaney will draft a memo to Zoning Board of Appeals regarding changes in the plans.
National Grid ACT Reliability Improvement Program – Notification that trees will be cut on Brook Street and Winter Street to prevent future power outages.
MSMCP Annual Meeting April 28threviewed



Boilerplate Conditions – Copies were made for Commission Members to take home and review and provide comment.
Conservation Land/Signage – Ms. Delaney reported that money was available to post signs at Conservation Land and Conservation Easements around town.  John Kemmett suggested that it would be a good Eagle Scout project for a Boy Scout or perhaps a Troop Project.  He will look into it.
Copies of Regulations/distribution - This item was tabled for the next meeting.
684 State Street – Future Request for Determination of Applicability.  Ms. Delaney reported that ZBA had denied a second dwelling for this project and was communicating with Town Counsel
Comprehensive Environmental Inc. – Greening Rooftops for Sustainable Communities –reviewed
Conference at Hynes Convention Center in Boston on May 11th & 12th - reviewed
